These Terms of Service ("Terms") govern your use of makebof.com and its related services (the "Service"), provided by MakeBOF ("MakeBOF", "we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

Eligibility and Accounts

You must be at least 18 years old to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.

The Service

MakeBOF uses third-party AI models to generate promotional images and videos from product information you provide. AI output can be inaccurate or unexpected. You are responsible for reviewing all generated content before you publish or use it.

We choose which AI models and providers to use, and we may change them at any time, for example when better or more affordable models become available. Your plan gives you a number of video credits each month. It does not include access to any particular AI model, model version or provider.

Your Content

You keep ownership of the content you upload and, to the extent permitted by law and by our AI providers' terms, the content generated for you. You grant us a limited license to host, process and transmit your content solely to operate the Service for you.

You confirm that you have the rights needed to use any product images, trademarks and other material you submit, and that your use of generated content complies with applicable law, advertising and disclosure rules, and the policies of TikTok and any other platform where you post it.

Acceptable Use

You agree not to:

• Create misleading, deceptive, defamatory, infringing or illegal content, or promote prohibited products.
• Impersonate any person or use another person's likeness without permission.
• Abuse, overload, reverse engineer or circumvent limits or security features of the Service.
• Resell or share access to the Service without our written permission.
• Create multiple accounts to evade plan limits.

Plans, Billing and Credits

Credits. Each plan includes a number of video credits per month. Different kinds of videos can cost different numbers of credits, as shown in the app. Credits are used only when a video finishes. If a video fails, you are not charged for it. On a paid plan, your monthly credits renew on your billing date each month. On the free plan, they renew each month on the day of the month you signed up. Monthly credits do not roll over to the next month.

Billing. Paid plans are billed in advance through our payment processor, monthly or yearly, and renew automatically until you cancel. We may change prices with advance notice. A new price applies from your next renewal.

Annual plans. An annual plan is paid once for 12 months. Your credits are added once a month on your billing day, not all at once, and unused monthly credits do not carry over. If you cancel, your plan stays active until the end of the year you paid for.

Changing plans. If you move to a higher plan, or from monthly to yearly billing, the change applies right away: you pay the new plan's full price, a new billing period starts that day, and monthly credits you hadn't used stay in your account as credits that never expire. If you upgrade from a yearly plan to a higher yearly plan, the unused part of your current year is credited toward the new yearly price. An upgrade also turns off a cancellation or pause you had scheduled. If you move to a lower plan, or from yearly to monthly billing, the change applies at the start of your next billing period.

Cancelling. You can cancel at any time from the billing page. Your plan stays active, with its remaining credits, until the end of the current billing period, and you won't be charged again.

Pausing. We may offer you the option to pause your subscription, for example for one month. While it is paused, you are not charged and you don't receive monthly credits. It restarts automatically at the end of the pause.

Credit packs. Extra credit packs are available to subscribers on paid plans. Purchased credits are used only after your monthly credits run out. They never expire and stay in your account if you change or cancel your plan.

Refunds. Payments are non-refundable, except where the law requires otherwise. If you think a charge was a mistake or something went wrong, email [email protected] and we will look at each request individually. If we refund a payment, the plan or credits it paid for are removed.

Emails

We send you emails about your account, such as sign-in codes, receipts and notices about your plan, for as long as you have an account. We may also send you marketing emails as described in our Privacy Policy. You can unsubscribe from marketing emails at any time with the link in each one.

Suspension and Termination

You may stop using the Service at any time. You can delete your account in your account settings, or by emailing us. Deleting your account cancels any subscription right away, without a refund for the rest of the billing period. Your account and content are then permanently deleted after 7 days. Until then you can contact us to restore it. After that, they cannot be recovered. Our Privacy Policy explains what we keep.

We may suspend or terminate accounts that violate these Terms or put the Service or other users at risk.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted or error-free, or that any content will achieve particular views, sales or results.

Limitation of Liability

To the maximum extent permitted by law, MakeBOF will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Changes

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.
